GENERAL CONDITIONS
1) DURATION: The rental will begin (check-in) from the selected day at 3 p.m. and will end on the selected day (check-out) at 10 a.m., unless time extension to be agreed upon in advance, for a maximum number of persons accommodated as indicated in the reservation.
2) RENT: The rent is agreed upon as per the selected rate for the duration
contractual period, to be paid in legal tender by the Tenant to Villa Molinello.
3) Terms of payment of rent: balance upon check-out.
4) The Tenant, by entering into this contract, declares that the real estate unit, for the entire period of the lease, will be used exclusively as his own residence.
5) The Tenant agrees to carry out adequate separation of waste in accordance with the regulations municipal regulations in force and, in addition, takes, formal note of the absolute prohibition of smoking in the indoor environments.
6) It is expressly forbidden for the Tenant to sublet or lend the real estate unit,
either totally or partially (art. 1456 C.C.).
7) In order to comply with the generic obligations of fairness and transparency as well as those specific ones regarding registration and communication to the Police Headquarters of the generalities of the lodgers provided for by Art. 109 T.U.L.P.S., the Tenant shall make available to Villa Molinello suitable identification documents relating to all guests who will benefit from the stay in the dwelling before allow them access.
8) The Tenant shall be prohibited from bringing into the dwelling persons other than those for whom suitable documents have been made available and without the prior authorization of Villa Molinello.
9) For the tenant is placed the express prohibition to change, either totally or partially, the use agreed use of the property (lease for civil residential use for tourist purposes) as well as to assign, either totally or partially, the lease to a third party.
10) The tenant is also expressly prohibited from engaging, directly or indirectly,
any conduct contrary to the condominium regulations (if any), just as it is made
expressly forbidden, to the tenant, to engage, directly or indirectly, in conduct that is unlawful or, however, injurious to public morality, morality or such as to cause harm to other tenants.
11) The Tenant acknowledges that failure to comply with Articles 6, 7, 8, 9, 10 is cause
of immediate termination of the contract. In such case, the Tenant expressly renounces any claim or demand for compensation.
12) The Tenant shall be fully responsible for the custody of the dwelling and its contents from the time of check-in and shall be liable to pay compensation for any damage caused, including costs related to inadequate waste management and failure to comply with the ban on smoking in the interior rooms.
13) As security for all obligations assumed under this contract, including the obligations of custody and timely return of the dwelling, and without prejudice to compensation for any greater damage, the Tenant shall pay a security deposit by way of non-interest bearing deposit in an amount equal to the balance of the reservation increased by € 100.00. The parties agree that in case of non-performance of the obligations undertaken under this contract, the Tenant shall be liable to the payment in favor of Villa Molinello of the sum of € 100 as a penalty, which will be
directly deducted from the amount paid by the Tenant as security deposit, except for greater damages. Conversely, the security deposit, if the conditions are met, will be returned at the time of check-out and may not be calculated as a deposit of rent.
14) The amount related to the security deposit is to be paid in legal tender from the
Tenant to Villa Molinello according to the following payment terms: balance at the time of the reservation.
15) The violation of one or more of the prohibitions set forth in this article shall be construed as a serious breach of the contractual obligations placed on the tenant and shall result in the immediate termination of the contract ope legis, with express waiver, by the tenant, of the return of the deposit paid and the obligation of the latter to compensate all the greater damages suffered and to be suffered by the landlord.
16) In view of the peculiarity and brevity of the use of the dwelling, the Tenant, should all or part of the need to use the dwelling for the period agreed upon, he/she may not request from Villa Molinello a reduction, not even partial, of the rent
agreed upon.
17) Villa Molinello, should it no longer be able to make the dwelling available for all
or part of the agreed period, shall provide the Tenant with a suitable alternative.
18) The Tenant expressly authorizes Villa Molinello to provide his/her personal data
to the building administrator or to third parties for fulfillments concerning the rental relationship or however related to it, pursuant to Legislative Decree 196/2003 and subsequent amendments.
19) The parties signing this agreement stipulate that for any and all future dispute arising from this agreement, or connected to the same, the Court of Forlì.
20) For anything not provided for in this contract, the parties make exclusive reference to the provisions of the civil code and local customs.
